These Terms and Conditions govern the relationship between you, the Client or Agent, and us, SEAGATE Travel Co. Ltd (hereinafter, “SEAGATE Travel”). By booking a SEAGATE Travel's tour program, you agree to be bound by these Terms and Conditions. They outline, among other things, our cancellation policy and certain limitations of liability. These terms affect your rights to sue, governing law, forum, and jurisdiction; please be sure to carefully read these terms and make sure you understand your rights and obligations and our rights and obligations.

 

Price

 

All prices quoted to the Client/Agent are on a net basis and in United States Dollars and valid according to the date specified on the SEAGATE Travel printed quotation and/or invoice issued to the Client/Agent. SEAGATE Travel guarantees that the prices or rates quoted to the Client/Agent are correct at the time of issuance of the Client’s/Agent’s quotation and/or invoice but are subject to change in accordance with market, tax or exchange rate fluctuation, with or without prior notice.

 

Reservation and confirmation

 

Reservations can be made to SEAGATE Travel office via website or email or fax. Upon confirmation of a reservation:

  •  a 30 % (thirty percent) deposit is required to secure your reservation

  • and the final payment for the total package tour or the services (70%: seventy percent) must be full received by SEAGATE Travel at least 10 days (ten days) prior to client's arrival in the destination country or starting date of the tour.

If the final payment is not received by the due date, the Client’s/Agent’s reservation will be cancelled and the Clients/Agents will have to pay the cancellation charges. SEAGATE Travel also reserves the right to correct any arrangement (including tours, programs, prices and services) in the best interest of its Client/Agent, with or without prior notice.

 

Payment

 

1. Payment by cash or swift/telegraphic transfer:

 

Except as otherwise agreed by SEAGATE Travel, Client’s payment shall be executed by cash or by swift or telegraphic transfer to the appropriate SEAGATE Travel bank account. Any bank charges levied by the sending banks (and mediate banks) relating to transfers to SEAGATE Travel must be paid by the Client/Agent.

Note: After your payment telegraphic transfer is done, please fax the receipt of the payment provided by the bank to us at: (844) 978-3158 , or scan the receipt and email it to us.

 

2. By credit card:

 

The client's payment can be also executed by credit cards. The clients are required to fill out the payment guarantee form/credit card authorization form provided by us, and then fax or email the scanned form to us. By this time, only  Visa card and Master card are accepted.

 

Note:

  • Credit cards are only used   for client's making deposit.

  • Payment by credit card: the client will have to pay the additional 3% of credit card transaction fee charged by the bank (Asia Commercial Bank, Vietnam).

 

Vouchers

 

Vouchers for booking arrangements and copy of the Client’s itinerary will be issued to the Client on arrival by an SEAGATE Travel representative.

 

Cancellation and refund

 

If you, a Client/Agent, cancel your trip, you must inform us  in writing. In that case, you will have to pay a cancellation charge. The Cancellation charges will be a certain percentage of the tour price as follows:

  • Before 45 days - 10% of the total tour price

  • From 45 days to 15 days - 20 % of the total tour price

  • From 15 days to 07 days - 25% of the total tour price

  • From 07 days to 02 days (48 hrs) - 50% of the total tour price

  • From 48 hours to arrival or no show - no refund

  • After the tour begins, any extra charges caused by clients' changes will be paid by clients. Any unused portion is neither refundable nor exchangeable.

 

We calculate your refund on the day when we receive the written cancellation by Vietnam time. All refunds to the client will be processed within 30 days of receipt of your cancellation. The service charge of the refund is USD40.00 per time.

 

Responsibilities

 

We, SEAGATE Travel, will always do our best to meet the Client’s/Agent’s satisfaction. However, it is the understanding of the Parties that as a tour operator, SEAGATE Travel acts as an intermediary between the Client/Agent and various suppliers, including airlines, hotels, transportation operators, local tourist offices and other contractors providing the services to the Client/Agent. SEAGATE Travel does not own or operate any of these Suppliers. As such, SEAGATE Travel is not liable to the Client/Agent by unsatisfactory services or failure to act of any suppliers or any third party. By utilizing the travel services of the suppliers, you, the Client/Agent, agree that you will look to such Suppliers for any accident, injury, property damage, delay, change in schedule, or personal loss to you or to those traveling with you, and that neither SEAGATE Travel nor any representative of SEAGATE Travel shall be liable.

 

The Client/Agent also warrants that SEAGATE Travel shall not be responsible and/or liable for any injury, loss, or damage to person or property, death, delay, or inconvenience incurred due to acts of God or force majored, acts of war or civil unrest, insurrection or revolt, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of accommodations, mechanical or other failure of airplanes of other means of transportation or for the failure of any transportation mechanism to arrive or depart on time, sanitation problems, lack of medical care, or for any other cause beyond the control of SEAGATE Travel.

 

SEAGATE Travel reserves the right to correct promotional or pricing errors at any time, or to increase the program price in the event of cost increases due to changes in airfares, cruise fares, currency fluctuations, taxes, or fuel surcharges.

 

Health Requirements

 

It is the Client’s responsibility to avail themselves with information regarding health requirement, medical and health insurance for the duration of their trip to the destination country.

 

Claims

 

All disputes, claims and litigation regarding the Services shall first be settled by way of negotiation and mutual understanding. In the event such negotiation and mutual understanding would fail, the disputes, claim or litigation shall be finally settled by local arbitration in Vietnam. All claims must be submitted in writing within 30 days after the end of the Services.
